Legal Win for Disabled Vermonter Needing Medicaid Services

On October 11, 2024, the Vermont Supreme Court ruled in favor of a Vermont man with disabilities who was represented by Vermont Legal Aid. The court ruled that the state’s staffing challenges do not prevent the Human Services Board from ordering the Department of Disabilities, Aging and Independent Living to provide the medically necessary services our client is supposed to receive.

State and federal law require Vermont to provide Medicaid services with “reasonable promptness,” yet K.M. has gone without services for four years. Unfortunately, his situation is not unique. VLA is grateful to K.M. and his mother for their advocacy around this critical problem faced by Vermonters with disabilities.
